Terms and Conditions

1.     Information 

a.       Information on how to submit your vote form part of these terms and conditions. Participating is deemed acceptance of these terms and conditions.

b.       By submitting your vote, you confirm that you are 16 years or older and that we may use your personal information as set out in these terms and conditions for the purposes of conducting this voting process and implementing this initiative.

 

2.     This initiative is promoted by Foodstuffs (N.Z.) Limited (Foodstuffs or New World).

3.     What our customers get to vote on

Participants are invited to place one vote per person, choosing from the following three options through the specific voting process mentioned further below:

a.       New World Plastic bags continue to be provided at no cost

b.       New World Plastic bags are charged at 5c per bag

c.        New World Plastic bags are charged at 10c per bag

 

Proceeds from the bag fee or levy, less GST, will go towards charities or causes of New World's choice.

4.     Eligibility 
Voting is open to residents of New Zealand who are 16 years and over.

Both New World Clubcard members and customers who are not members of New World's Clubcard programme may vote.

5.     Entry 
Voting opens at midday 14 September 2017 and closes at midnight 8 October 2017 (
Voting Period). No votes will be accepted outside of the Voting Period. 

a.       If you are a Clubcard member, you will be asked to enter your Clubcard number in order to vote.

b.       If you are not a Clubcard member, you will need to enter a valid email address in order to vote.

Limit of one (1) entry per person during the Voting Period, using either a Clubcard member number or a valid email address.

6.     When you find out the vote results
The voting result will be announced at on during the week commencing 9th October 2017.

7.     Voting integrity and margin of error

Multiple votes will be disallowed.  If more than one vote per Clubcard is registered only the first vote will be counted. If an email address supplied by a non-Clubcard member or Clubcard number is used more than once, any vote after the first vote is void. 

8.     Voting outcome

Foodstuffs will endeavour to deliver on what our customers say that you want through this vote. If the majority of our customers vote for either the 5c or 10c levy, instead of the no cost option, then Foodstuffs will recognise that the majority is in favour of a levy. If there is a draw between the 5c and 10c levy votes, Foodstuffs will make a final decision between the 5c or 10c levy in its sole discretion. However, for various reasons Foodstuffs may not be able to offer this plastic bag levy programme and reserves the right to adapt or choose not to implement this plastic bag levy initiative at its discretion. 

9.     If the levy vote wins, how will the levy be used?

The funds will only go to charities or causes which New World selects in its sole discretion.

It is our intention that the proceeds of the levy charged less GST will be allocated to our selected charities.

Donations made out of the bag levy will not be made towards:

a.       Political parties or lobby groups

b.       Projects which the business see as the responsibility of local or central government

10.  Other legal stuff 

a.       Foodstuffs' decision is final and no correspondence will be entered into.

b.       Foodstuffs reserves the right, at any time, to verify the validity of votes and voters (including a voter's identity, age and number of votes) and reserves the right, in its sole and absolute discretion, to disqualify any vote that it believes involves any tampering or breaches any of these terms and conditions.

c.        Foodstuffs may change these terms and conditions at any time.

d.       Foodstuffs accepts no responsibility for late, lost or misdirected votes or for any technical issues arising which prevent a vote being uploaded.

e.       Because this issue is important to Foodstuffs and to our customers, Foodstuffs may accept error corrections during the Voting Period in its sole discretion.

 

11.  Privacy and voter acknowledgement

All entries remain the property of the Promoter. All personal information will be collected and stored by the Promoter in accordance with the Privacy Act 1993. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 1993. When you submit your vote your personal information may be used to collate results as set out in these terms and conditions. By voting, you consent to the use of your information as described above.

12.  Will I be notified of the voting results?

a.       Yes, if you are a Clubcard member and have previously provided us with an email address you have authorised us to contact you in accordance with Clubcard terms and conditions, which can be viewed at https://www.clubcard.co.nz/newworld/en/clubterms. You can opt out of receiving emails by logging in, contacting the Clubcard Helpline on 0800 80 70 70 or clicking on the unsubscribe link within an email you receive from us.

b.       Yes, if you are a Clubcard member who has opted out of receiving communications from us, but you have checked the opt in box when submitting your vote. Note, if you choose to opt in again you will receive email promotions as well as the Bag Vote results.

Why are we asking New Zealand to vote?

New World is considering introducing a small charge for plastic bags to help reduce their use, with any money raised going to environmental and community causes. But, we want to be sure it’s what New Zealanders want, so we’re inviting customers to vote.

There are three choices: 5 cents per bag charge to go to community and environmental causes, 10 cents per bag charge to go to community and environmental causes, or no introduction of a charge.

Anyone can post a vote online at www.bagvote.co.nz from midday Thursday 14 September through to midnight 8 October 2017. Whatever the result we’ll continue to work on reducing plastic bag use, providing more reusable bag options and increasing soft plastics recycling - reduce, reuse, recycle.

If the majority of our customers vote for a bag charge, a number of causes will benefit including the Starship Foundation, our Food for Thought education programme and SEA CLEANERS.
